Agreeing to these terms

Domisura is operated by Domisura Holdings Inc., a company incorporated in Alberta, Canada. “We” and “us” below mean Domisura Holdings Inc..

By creating an account or using Domisura, you agree to these terms. If you are using it on behalf of a company — a builder, a brokerage, a property manager — you are confirming you have the authority to accept them for that company.

If you do not agree, do not use the service. Our handling of personal information is set out separately in the Privacy Policy, which forms part of this agreement.

What Domisura is

Domisura keeps a record for a home: the systems and appliances in it, their warranties, what maintenance they need, and what has been done to them. A builder can hand that record over at possession, an owner can add to it, and it transfers to the next owner when the house is sold.

The service is in early access. Features will change, and some of what you see is still being built.

Your account

You need an account to use the service, you must give accurate information when you create one, and you are responsible for what happens under it. Keep your sign-in details to yourself, and tell us at hello@domisura.com if you believe someone else has got into your account.

You must be at least 18 years old.

The record, and who it belongs to

The maintenance and warranty history of a property is attached to the address rather than to your account. That is the design, and using the service means accepting it.

In practice:

• When ownership transfers, the history stays with the property and the next owner gets access to it.
• Your name does not go with it. To a later owner, your entries show as coming from a previous owner.
• Content you mark private stays with you and does not transfer.
• Deleting your account does not delete the property’s history. It continues without you attached to it.

You keep ownership of what you upload. You grant us the permission we need to store it, process it, show it to the people entitled to see it, and carry it forward with the property as described above — and nothing beyond that.

Only put things on the record that you have the right to put there. If you upload somebody’s invoice or contact details, you are confirming you are entitled to.

What the record is not

Read this part. It is the one that matters if something goes wrong with your house.

• It is not a warranty. Domisura records warranty terms and tracks when they expire. It does not provide, extend, underwrite or honour any warranty. Your warranty is with your builder, your manufacturer or your warranty provider, and the terms of those agreements govern — not what our screen shows.
• It is not professional advice. Maintenance schedules and reminders are general guidance assembled from manufacturer documentation and common practice. They do not replace your equipment’s own manual, a building code, or a licensed trade. For anything involving gas, electricity, structure or water, get a qualified person.
• It is not a guarantee of accuracy. Much of the record is entered by people — builders, contractors, owners — and some is read automatically from photographs. We show where each value came from so you can judge it. Confirm anything that matters before you rely on it, particularly a model number you are about to buy a part against.
• It is not a substitute for a home inspection. A record of what a house contains is not an assessment of its condition.

Contractors and other people you bring in

You can invite a contractor, a builder or a property manager to see or add to your record. We pass work along and keep track of it; we do not perform it, employ the people who do, vet them, or supervise them.

Any agreement about work on your house is between you and that contractor. We are not a party to it and we are not responsible for the quality, timing, pricing or safety of what they do.

Using it properly

Do not:

• Try to get at a property record you have no right to see, or claim a property that is not yours.
• Upload anything unlawful, or anything containing malware.
• Attempt to break, overload, probe or reverse-engineer the service.
• Scrape or bulk-extract data from it.
• Use it to send anyone unsolicited messages.

Claiming a property you do not own is the one we treat most seriously, because it is an attempt to reach somebody else’s home. We verify claims, and we refuse or reverse them.

Availability

We aim to keep the service running and we do not promise it always will be. It is early access: there will be interruptions, maintenance, and occasional changes that remove things. We are not liable for losses arising from the service being unavailable.

Keep your own copies of documents that matter to you. A record is not a vault.

Ending it

You can stop using Domisura and ask us to close your account whenever you like. We may suspend or close an account that breaches these terms, particularly one attempting to reach a property it has no right to.

Closing an account does not remove the property history, for the reason set out above.

Liability

The service is provided as it is, without warranties of any kind, to the fullest extent the law allows. Some jurisdictions do not allow certain warranties to be excluded, and nothing here removes a right you have that cannot be excluded.

To the extent the law allows, Domisura Holdings Inc. is not liable for indirect, incidental or consequential losses, for lost profits, or for damage to property arising from maintenance performed or not performed. Where liability cannot be excluded, it is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred Canadian dollars.

Changes to these terms

We may update these terms. The effective date at the top will change, and where an update materially affects your rights we will tell you directly rather than relying on you to re-read this page. Continuing to use the service after an update means you accept it.

Governing law

These terms are governed by the laws of Alberta and the laws of Canada that apply in it. Disputes go to the courts of Alberta, Canada.
